Gymmit Terms of Service
1. Agreement
These Terms of Service govern your use of Gymmit, including the Gymmit mobile applications, backend services, websites, support channels, and related features (collectively, the "Service"). By creating an account, accessing the Service, or tapping a button that indicates acceptance, you agree to these Terms.
Gymmit is operated by Michael Nguetsa.
If you do not agree, do not use the Service.
2. Eligibility
You may use the Service only if:
- you are at least 18 years old;
- you can form a binding legal agreement;
- your use of the Service is permitted under applicable law; and
- you have not previously been suspended or removed from the Service.
You are responsible for ensuring that your account information is accurate and kept current.
3. Nature of the Service
Gymmit helps users discover workout partners, communicate with training partners, manage workouts, and use related membership and reward features.
Gymmit is not:
- a medical service;
- a personal training or coaching provider;
- a background-check service;
- a guarantor of any user's identity, honesty, conduct, safety, or fitness level; or
- a substitute for your own judgment when meeting or training with another person.
Use caution when meeting anyone in person. You are solely responsible for your decisions, interactions, travel, training activity, and any personal or physical consequences arising from those interactions.
4. Account Registration and Security
You must provide a valid phone number and complete the verification flow required by the Service. You are responsible for:
- maintaining the security of your device and account session;
- restricting unauthorized access to your account;
- promptly informing Gymmit if you suspect misuse or unauthorized access; and
- all activity that occurs under your account unless caused solely by Gymmit's own security failure.
You may not share, sell, transfer, or lend your account to another person.
5. Acceptable Use
You agree not to:
- impersonate another person or misrepresent your identity;
- provide false, misleading, or deceptive profile, workout, or membership information;
- harass, threaten, stalk, exploit, or harm another user;
- use the Service for unlawful, discriminatory, hateful, sexually exploitative, or abusive conduct;
- upload or send pornographic, sexually exploitative, violent, hateful, abusive, harassing, or otherwise objectionable content;
- scrape, copy, harvest, index, mirror, or systematically extract Service content or user data;
- test, probe, or bypass security or rate limits;
- reverse engineer or interfere with the Service;
- upload malicious code or use the Service to distribute spam;
- use the Service to promote commercial services without written permission; or
- use Gymmit in a way that creates unreasonable infrastructure, fraud, moderation, safety, or legal risk.
Gymmit may monitor, limit, suspend, or terminate access where necessary to protect users, the Service, or legal compliance.
6. User Content and Limited License
You retain ownership of content you submit, including profile text, photos, messages, workout details, reports, and other account content ("User Content").
You grant Gymmit a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, process, display, and distribute User Content only as reasonably necessary to:
- operate and improve the Service;
- provide account, matching, messaging, workout, moderation, support, billing, notification, and reward functions;
- filter or review content for safety, abuse, fraud, spam, and policy violations;
- investigate abuse, fraud, safety reports, and policy violations; and
- comply with law and enforce these Terms.
You represent that you have all rights necessary to submit User Content and that your content does not violate law or third-party rights.
7. Safety, Moderation, Reports, and Blocking
Gymmit may offer reporting, blocking, messaging restrictions, and other safety controls. These tools support user safety but do not guarantee prevention of misuse or harm.
Because Gymmit includes user profiles, photos, direct messages, and other user-generated content, Gymmit may use automated and manual methods to prevent or respond to objectionable material and abusive behavior. Users can report concerning profiles or behavior and block abusive users from the Service. Gymmit may review reports and take timely action where appropriate.
Gymmit may remove content, limit visibility, disable messaging, suspend accounts, preserve records, or cooperate with law enforcement where reasonably necessary.

8. Memberships, Billing, Subscriptions, and Rewards
Some features may require an active paid membership. Subscription access may include benefits such as unlimited connection requests, workout scheduling, boosts, viewing connection requests, and other premium features shown in the app.
Gymmit currently presents a monthly membership price of 9,99 EUR per month where supported. The actual price, currency, taxes, trial terms, and renewal terms are shown in the App Store purchase sheet or other approved billing surface before purchase.
Subscriptions may renew automatically unless cancelled. Billing, renewals, cancellation rights, and refunds are generally governed by the platform through which you purchased the subscription, including Apple App Store subscription settings for iOS purchases, except where law requires otherwise.
If your subscription ends, expires, is cancelled, is refunded, or cannot be validated, paid features may become unavailable. Restoring purchases may be available from the app where supported by the billing provider.
Free users may continue using limited free features where available, subject to rate limits, quotas, and feature restrictions described in the app.
If Gymmit offers points, rewards, offers, or promotional benefits:
- they have no cash value unless explicitly stated otherwise;
- they may be modified, limited, or withdrawn at any time to the extent permitted by law;
- misuse, fraud, or abuse may result in forfeiture.
9. Messaging, Meetings, and Training Activities
Gymmit may enable private messaging, workout scheduling, and in-person meetups between users. Gymmit does not supervise, control, or endorse any interaction between users.
You assume all risk arising from:
- conversations and information exchanged with other users;
- in-person meetings;
- training sessions;
- transportation;
- injuries, disputes, theft, harassment, or misconduct; and
- reliance on another user's statements, availability, or fitness ability.
10. Third-Party Services
The Service may rely on third-party providers for functionality such as phone verification, cloud hosting, mapping or place search, subscription processing, push delivery, storage, analytics, security, moderation, and support operations.
Gymmit is not responsible for outages, errors, or acts of third-party services beyond Gymmit's reasonable control.
You must also comply with applicable third-party terms when using the Service, including app store terms, payment-provider terms, mobile network terms, device-platform terms, and any other terms that apply to services or technology used with Gymmit.
11. Apple App Store Terms
If you download, access, or use Gymmit through Apple App Store or on an Apple-branded product, the following additional terms apply:
- These Terms are between you and Gymmit, not Apple. Gymmit, not Apple, is solely responsible for the Service and its content.
- Your license to use the Gymmit app is a limited, non-transferable license to use the app on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions, including applicable Usage Rules. The app may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing where Apple permits it.
- Gymmit is solely responsible for maintenance and support for the Service, as specified in these Terms or required by law. Apple has no obligation to provide maintenance or support for Gymmit.
- To the extent any warranty cannot be disclaimed under applicable law, Gymmit is responsible for that warranty. If the Gymmit app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation for Gymmit, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure are Gymmit's responsibility.
- Gymmit, not Apple, is responsible for addressing claims from you or any third party relating to the Service or your possession or use of the app, including product-liability claims, legal or regulatory compliance claims, and claims under consumer-protection, privacy, or similar laws.
- If a third party claims that the Gymmit app or your possession and use of the app infringes that party's intellectual-property rights, Gymmit, not Apple, is responsible for investigating, defending, settling, and discharging that claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
12. Service Availability and Changes
Gymmit may modify, suspend, or discontinue any part of the Service at any time. Features may vary by region, device, app version, subscription status, or operational needs.
Gymmit does not guarantee uninterrupted availability, error-free operation, or compatibility with every device, network, or operating system version.
13. Termination
You may stop using the Service at any time and may delete your account through available account controls.
Gymmit may suspend or terminate your access immediately if Gymmit reasonably believes that:
- you violated these Terms;
- your conduct creates safety, fraud, abuse, legal, or operational risk;
- your account is associated with unlawful behavior; or
- suspension or termination is needed to protect users or the Service.
Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnity, dispute provisions, and enforcement rights.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMMIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Gymmit does not warrant that:
- the Service will be uninterrupted, secure, or error-free;
- matches or connection suggestions will be suitable, compatible, safe, or successful;
- any user is truthful, qualified, or safe;
- any message, workout plan, notification, or response will be delivered or received; or
- the Service will prevent injury, harassment, misconduct, or loss.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMMIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR PERSONAL INJURY ARISING OUT OF OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMMIT'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
- the amount you paid to Gymmit for the Service in the 12 months before the event giving rise to the claim; or
- EUR 100.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
16. Indemnity
To the extent permitted by law, you will indemnify and hold harmless Gymmit and its affiliates, officers, employees, contractors, and licensors from claims, losses, liabilities, and expenses arising from:
- your use of the Service;
- your User Content;
- your interactions with other users;
- your breach of these Terms; or
- your violation of law or third-party rights.
17. Privacy
Your use of the Service is also governed by the Gymmit Privacy Policy. If there is a conflict between the Privacy Policy and these Terms on a privacy-specific topic, the Privacy Policy controls for that topic.
18. Governing Law and Venue
These Terms are governed by the laws of the jurisdiction in which the Gymmit operator is established, excluding conflict-of-law rules, except where mandatory consumer protections require otherwise.
Any dispute that cannot be resolved informally will be brought in the competent courts of that jurisdiction, unless mandatory law gives you the right to bring claims elsewhere.
19. Changes to These Terms
Gymmit may update these Terms from time to time. When changes are material, Gymmit may provide notice through the app, by email, or by another reasonable method. Continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms.
